Private Swimming Pools and Fencing

All pools that hold more than 400mm of water need a building consent for the safety barrier (fence). A pool holding more than 35,000 litres supported directly on ground will require a building consent for the pool structure and installation.
Section 162D of the Building Act requires councils to inspect pools every three years to make sure they meet requirements. Warranted Council staff are entitled to enter properties to inspect pools, with inspections carrying a fee of $205.

Common ways in which pool fencing fails Building Act requirements:
- the gate does not close automatically
- the fence has deteriorated, with gaps allowing access or climbing
- vegetation near the fence, inside or outside, provides assistance to climbing
- temporary pools purchased without consideration of fencing requirements.
