Food Stall and Mobile Food Truck Operators

If you want to sell food in Masterton you must be registered under the Food Act 2014, unless you are exempt from registration.

Some examples of exemptions are:

  • Fundraising food sales (up to 20 times per year)
  • One-off personal profit sales (once per calendar year)
  • Some low-risk or community group activities

Who is exempt from Food Act requirements? | NZ Government

To sell food in public, you must:

  • Be registered with Masterton District Council, or
  • Be registered with another council and verified by a Ministry of Primary Industries (MPI) approved verifier, or
  • Be registered with MPI

You might also need:

  • The landowner’s permission.
  • A license to trade in public places e.g. Hawker or Itinerant Trader or Mobile Trader License.

Trading Restrictions

If a business is only registered with one council, it might only be valid within that council’s boundaries. There may be some exceptions, contact the Environmental Health Team of your council to confirm where you can operate.

Under section 137 (1) (b) of the Food Act 2014

s137 Recognition of territorial authorities for certain verification functions and activities

(1) A territorial authority is recognised as the agency that is responsible for the management and carrying out of verification functions and activities in relation to a food business that is -

(a) operating under a food control plan that is based on a template or model issued under section 39; and

(b) operating entirely within the district of that territorial authority; and

(c) selling food primarily directly to consumers.

To legally trade outside your council area you can:

  • Sell once within a calendar year only, or
    • have your food business verified by an MPI-approved verifier, or
    • you could register your food business with MPI.

You must also have:

  • A valid Food Registration Certificate, and
  • be operating within the scope of your registration.

If you're not registered and don’t qualify for an exemption, you are breaking the law and may be fined.

Home kill, hunted, and wild food (recreational catch) cannot be used, cooked and sold.
